NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

Void where prohibited. The "Cincinnati Music Festival Register To Win" Sweepstakes (“Sweepstakes”) will begin on July 23, 2020 at 1:00 PM EST and end on July 25, 2020 at 11:00 PM EST (“Sweepstakes Period”). All times in the Sweepstakes refer to Eastern Time (“EST”). Odds of winning depend upon the number of eligible Entries received as defined in the Official Rules. Sweepstakes is subject to all applicable federal, state and local laws.

 

ELIGIBILITY: Open only to permanent, legal United States residents who are physically residing in one (1) of the fifty (50) United States or the District of Columbia (excluding Puerto Rico, Guam, the Virgin Islands and other United States territories), who are eighteen (18) years of age or older as of the start of the Sweepstakes Period, a valid ticket holder, and are a wireless service subscriber from a Carrier (as defined below). Officers, directors, and employees of Sweepstakes Entities (as defined below), members of these persons’ immediate families (spouses and/or parents, children, and siblings, and each of their respective spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter or win the Sweepstakes. Sweepstakes Entities, as referenced herein, shall include Santangelo Group, Inc. (“Sponsor”), A (“Administrator”), and each of their respective parent, subsidiary, and affiliate companies, and their administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes.

 

 

HOW TO ENTER: You may enter the Sweepstakes during the Virtual Cincinnati Music Festival by visiting our website, https://www.cincymusicfestival.com and clicking on the register to win icon, (b) correctly and accurately complete all required information on the online registration form and (c) click on the “Submit” button. 

 

 

You may enter once during the Sweepstakes Period. Multiple Entries received from any person beyond this limit will void all such additional Entries. Entries generated by a script, macro, or other automated means or by any means that subverts the entry process will be disqualified. Sponsor’s computer shall be the official timekeeper for all matters related to this Sweepstakes. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the authorized account holder of the phone number associated with the submitted entry, provided that person is eligible (as provided above). Winner may be required to show proof of being the registered account holder. “Authorized account holder” is defined as the person assigned to a phone number by a Carrier or an organization responsible for assigning phone numbers. Entry constitutes permission (except where prohibited by law) to use entrant’s name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval. 

 

PRIZES: There will be a total of one (1) prize awarded (“Prize”). Each Prize will consist of the following: Two (2) club level tickets to Friday and Saturday of the Cincinnati Music Festival for LIFE.

 

All details of Prize will be determined by Sponsor in their sole discretion. Sponsor reserves the right to substitute Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winners. All other expenses not specifically mentioned herein, including but not limited to, airfare, airport taxes and fees, baggage fees, ground transportation not specifically delineated, food, beverages, additional hotel amenities or fees and gratuities, are the responsibility of the Winners and/or traveling companions. The Sponsor is not responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air transportation carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations necessitated by same. The Sponsor shall not be liable for any loss or damage to baggage and/or personal property. Hotel and other accommodations are subject to availability. Each Grand Prize Winner and their respective traveling companion must travel on same itinerary. Prizes cannot be transferred by Winners or redeemed for cash and are valid only for the items detailed above, with no substitution of Prize by Winners. If Prize is unclaimed within a reasonable time after notification from Sponsor, as determined by Sponsor in their sole discretion, it will be forfeited and, time permitting, alternate Winners may be selected from the remaining eligible Entries at Sponsor’s sole discretion. 

 

Sponsor shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize due to reasons beyond Sponsor’s control, and are not responsible or liable for any expenses incurred as a consequence thereof. Date and/or time of Festival is subject to change.  Festival is subject to cancellation. If Winners choose to attend the Festival with no Guests, the remaining elements of Prize shall constitute full satisfaction of Sponsor’s Prize obligation to Winner and no additional compensation will be awarded. Guests, if any, may be required to execute and return releases of liability and, where legal, publicity releases (collectively, “Guest Documents”), which must be returned with the Sweepstakes Documents, or Guest portion of the Prize will be forfeited. If any Guest is a minor, Winner must be such minor’s parent or legal guardian and must execute and return the Guest Documents on such minor’s behalf.

 

In the event a prize winner (and/or his or her Guest) (if applicable)) engage in behavior that (as determined by Sponsor or any prize provider in its or their sole and absolute discretion) is obnoxious, inappropriate, or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the prize or other applicable experience early. 

 

WINNER SELECTION AND NOTIFICATION: On July 25, 2020, one (1) potential Winner will be selected in a random drawing by representatives of Sponsor from all eligible Entries received during the Sweepstakes Period. DJ DNICE will announce the winner live during his performance. Sponsor will make two (2) attempts to notify potential Winners by email at the email address submitted at the time of entry. Sponsor and/or Administrator may share potential Winners’ name and contact information with Sweepstakes Entities and/or any prize provider, as applicable, if necessary. Potential Winners may be required to execute and return an affidavit of eligibility, release of liability and, except where prohibited, publicity release (collectively, “Sweepstakes Documents”) within the time period specified at notification before being eligible to receive his or her prize.   Noncompliance within this time period will result in disqualification and, at Sponsor’s sole discretion, an alternate potential Winner(s) may be selected from the remaining eligible Entries. If potential Winner(s) cannot be reached, is found to be ineligible, cannot or do not comply with these Official Rules, or if Prize (as defined below) or prize notification is returned as undeliverable, potential Winner(s) will be disqualified and, time permitting, at Sponsor’s sole discretion, an alternate potential Winner(s) may be selected from the remaining eligible Entries. Limit one (1) Prize per family or household.

CONDITIONS: By entering this Sweepstakes, you agree, represent and warrant that: [1] you will be bound by the Rules and the Sponsor’s decisions, which shall be final in all respects; [2] the Entry becomes solely the Sponsor’s property and will not be returned;[3] you release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in the Sweepstakes or any Sweepstakes-related activity or travel or from any interaction with, or downloading of, computer Sweepstakes information;  [4] the prizes are awarded “AS IS” and WITHOUT WARRANTY  OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose); [5] any winner’s acceptance of any prize constitutes the grant to Sponsor and assigns of an unconditional right to use that winner’s name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the Sweepstakes for any programming, publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [6] in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor’s reasonable control, corrupt,  prevent or impair the administration, security, fairness or proper play of the Sweepstakes, so that  it cannot be conducted as originally planned, Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Sweepstakes; and in such event, to select winners by such method as Sponsor in its sole discretion shall consider equitable; [7] the Releasees are not responsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to: errors in the advertising,  Rules, selection and announcement of the winner and distribution of the prizes; [8] any portion of any prize not accepted or used by any winner will be forfeited; [9] the Releasees are not responsible for any inability of any winner to accept or use any prize (or any portion thereof) for any reason; [10] the Sponsor has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes; (b) violating the Rules; (c) violating the terms of service, privacy policy or other terms, conditions of use and/or general rules or guidelines of any Sweepstakes property or service; (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or (e) for any other good cause as determined solely by the Sponsor; [11] all disputes, claims and causes of action at law or in equity (individually, “Claim”) arising out of or relating to this Sweepstakes, the meaning or interpretation of the Rules or any prize awarded shall be resolved by applying the laws of Ohio, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts within that state and [12]Sponsor has the right to modify prize award procedures at its sole discretion. Administrator, Sponsor, and their respective subsidiaries, affiliates, successors, assigns; and each of all of the foregoing entities’ respective officers, directors, owners, shareholders, members, managers, partners, principals, employees, artists, agents and representatives (individually and collectively “Released Parties”) shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or other irregularity that may be caused or contributed to (i) by any wrongful, negligent, or unauthorized act or omission of any third party; or (ii) by any cause, condition, or event beyond the control of the Released Parties, including, without limitation, any act of God, war, terrorism, riot, hurricane or fire. BY ENTERING THE SWEEPSTAKES, ENTRANT FULLY AND UNCONDITIONALLY RELEASES, DISCHARGES AND HOLDS HARMLESS EACH RELEASED PARTY FROM AND AGAINST ANY AND ALL CLAIMS, COSTS, EXPENSES, ATTORNEY’S FEES, DAMAGES AND OTHER LIABILITIES ARISING OUT OF OR RELATING TO ENTRANT’S PARTICIPATION IN THIS SWEEPSTAKES AND SWEEPSTAKES-RELATED ACTIVITIES (SUCH AS ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE), INCLUDING, WITHOUT LIMITATION, DEMANDS, CLAIMS AND CAUSES OF ACTION FOR BREACH OF CONTRACT, NEGLIGENCE, BODILY INJURY (INCLUDING DEATH), PROPERTY DAMAGE, LOSS OF BUSINESS, LOSS OF WAGES AND/OR EARNINGS, LOSS OF CONSORTIUM, CONSEQUENTIAL DAMAGES, PUNITIVE DAMAGES AND ALL OTHER FORMS OF CLAIMS, LIABILITIES AND DAMAGES.
